APP LIABILITY WAIVER 

LIABILITY WAIVER AND INFORMED CONSENT
Effective upon account creation or service use

Please read this waiver carefully before using any services provided by Alpha Omega Personal Fitness.

By creating an account and/or participating in any services offered by Alpha Omega Personal Fitness, including but not limited to online personal training, fitness programming, coaching sessions, exercise demonstrations, and related virtual fitness services (collectively, the “Services”), you acknowledge and agree to the following:

1. Voluntary Participation and Assumption of Risk

I understand that engaging in physical exercise, even virtually, involves inherent risks, including but not limited to muscle strains, joint injuries, cardiac events, and other potential health complications.
I voluntarily choose to participate and assume full responsibility for any injuries or damages that may occur as a result of my participation.

2. Health and Medical Clearance

I confirm that I am in good physical health, have no condition that would impair my ability to participate safely in the Services, and have either:

• Consulted a physician prior to participation, or

• Voluntarily chosen not to, accepting all associated risks.

I understand that Alpha Omega Personal Fitness is not a medical provider and does not offer medical advice.

3. Release of Liability

To the fullest extent allowed by law, I hereby release, waive, and discharge Alpha Omega Personal Fitness, its owners, employees, contractors, and affiliates from any and all claims, liabilities, demands, damages, or causes of action, known or unknown, arising out of or related to my participation in the Services — including but not limited to claims for personal injury, property damage, or death, regardless of cause.

4. Technology Limitations and Remote Nature of Services

I acknowledge that all Services are provided virtually and that Alpha Omega Personal Fitness cannot supervise or control my exercise environment.
I understand that I am responsible for ensuring my surroundings are safe, that my equipment is functioning properly, and that I perform all exercises at my own risk and discretion.

5. Minors Policy

Alpha Omega Personal Fitness does not accept clients under the age of 18 unless:

• The services are part of custom programming approved by Alpha Omega, and

• A parent or legal guardian has provided written consent to participate and accept this waiver on the minor’s behalf.

6. No Guarantees

I understand that fitness results vary from person to person and no specific outcomes have been promised or guaranteed.

7. Photo/Video Use (Optional Consent)

I grant Alpha Omega Personal Fitness the right to use any images, screenshots, or video submissions I voluntarily provide for promotional or educational use. I may revoke this consent at any time by notifying the company in writing.

8. Governing Law

This waiver shall be governed by the laws of the state in which Alpha Omega Personal Fitness is primarily based (e.g., Florida, if applicable), and any legal disputes shall be resolved in that jurisdiction.

Final Acknowledgment

By creating an account, booking a consultation, or participating in any Services provided by Alpha Omega Personal Fitness, I confirm that I have read, understood, and voluntarily accept the terms of this Liability Waiver.
